1. Terms of Service
1.1 What 868POS is
868POS is a point-of-sale and business management platform: a register system, inventory and staff management tools, an optional online storefront, and related features (delivery, loyalty, reporting, and more). It is provided to businesses ("Owners," "Businesses") and their staff, and separately to customers of those businesses who create a shopper account to order, book, or track a delivery ("Shoppers").
1.2 Acceptance
By activating a business license, creating a staff login, or creating a shopper account, you agree to these Terms of Service and the Privacy Policy below. If you do not agree, do not use the platform.
1.3 Your responsibilities
- You're responsible for the accuracy of the information you enter — business details, inventory, prices, and records kept using the platform.
- You're responsible for keeping your login credentials, license key, and any staff PINs or passwords confidential, and for all activity that happens under your account.
- You agree to use the platform lawfully — not to defraud customers, evade tax obligations, or otherwise violate applicable law using tools the platform provides.
- Businesses are responsible for their own compliance with tax, consumer protection, food safety, and any other laws that apply to their specific business — the platform provides tools (e.g. tax calculation, receipts) but does not itself ensure legal compliance on a business's behalf.
1.4 Payments
868POS does not process or store payment card details itself. Online and card payments are handled entirely by third-party payment processors (currently PayPal and WiPay) that a business connects with their own account — each governed by that processor's own terms. 868POS is not a party to those payment transactions and is not responsible for a payment processor's own errors, outages, or disputes.
1.5 Independent delivery drivers
Delivery drivers on the platform are independent — not employees of 868POS or of the businesses whose deliveries they carry out. Businesses and shoppers interact with drivers at their own discretion; 868POS facilitates the connection but is not a party to the delivery arrangement itself.
1.6 Changes to the platform and these terms
Features may be added, changed, or removed as the platform evolves. These terms may be updated to reflect that — the "Last updated" date above will change, and material changes will be highlighted in the platform where practical. Continued use after an update means you accept the revised terms.
1.7 Suspension and termination
A business's access may be suspended or terminated for violating these terms, non-payment of applicable fees, or unlawful use of the platform. A business may stop using the platform at any time; a shopper may delete their account at any time (see Privacy Policy below).
2. Limitation of Liability
This includes, without limitation: errors in calculations, reports, or records generated by the platform; downtime or unavailability; loss of data due to device failure, connectivity issues, or otherwise; actions taken by independent delivery drivers; and the acts of third-party services the platform relies on (payment processors, hosting infrastructure, Google services). Businesses remain responsible for verifying their own financial records rather than relying solely on the platform.
3. Privacy Policy
3.1 What we collect
For businesses and staff: business name, contact details, location(s), employee names and roles, and the sales, inventory, and financial records a business enters or generates while using the platform.
For shoppers: name, email, and profile photo (from Google Sign-In), order history, saved delivery address, and — if applicable — loyalty points balance and delivery driver application details (phone number, vehicle type).
3.2 How it's used
Information is used only to provide the platform's own functions: processing orders and payments, running loyalty and delivery features, generating reports for a business's own records, and enabling account sign-in. It is not used for advertising, and it is not analyzed or repackaged for any purpose beyond operating the platform itself.
3.3 Who it's shared with
- Google Firebase — the secure database and authentication infrastructure the platform runs on. Firebase stores account and business data under Google's own infrastructure security practices.
- Payment processors (PayPal, WiPay) — only when a payment is actually being made, and only the information needed to process that specific payment. 868POS itself never receives or stores card numbers.
- Google Maps / device location — used only for delivery-distance features, and only with the device's own permission at the time.
None of these providers are permitted to use the data for their own marketing purposes under this arrangement — they act strictly as infrastructure for delivering the platform's own functions.
3.4 Data retention and deletion
A shopper can delete their account and associated data at any time by contacting the business or platform support. A business's own records are retained for as long as the business uses the platform, consistent with reasonable recordkeeping needs; a business owner may request deletion of their business's data upon closing their account, subject to any recordkeeping obligations required by law (e.g. tax records).
4. Security
The platform is built with the following safeguards:
- Role-based access control — staff only see and do what their role permits (e.g. a cashier cannot access payroll or void a sale without approval).
- Server-enforced data rules — access to business data is enforced at the database level, not just in the app itself, so a modified or compromised client can't bypass these protections.
- No raw payment data ever touches 868POS — all card handling is delegated to PCI-compliant payment processors.
- Verified identity for sensitive actions — actions like claiming a delivery job or redeeming loyalty points are checked against a verified sign-in token, not just a value the app happens to send.
- Independent, ongoing security review — the platform is regularly reviewed for the kinds of gaps described above, and issues found are fixed as part of normal development.
No system is perfectly secure, and no platform can guarantee against every possible failure — this section describes real, current safeguards, not a guarantee of invulnerability.
5. For Shoppers
Creating a shopper account is free and is used only to place orders, track deliveries, and use loyalty features across businesses on the platform. A shopper account is separate from any individual business's own data — a business cannot see your account beyond the orders you've placed with them. 868POS is not the seller of record for what you order — the business you're ordering from is; 868POS provides the platform that connects you.
6. For Independent Delivery Drivers
Applying to become an independent delivery driver is free. Approval is at 868POS's discretion and requires identity verification (a selfie and a photo of a government-issued ID, such as a driver's license or national ID) and valid banking details, so that payouts can be reliably matched to the person who earned them. Applying does not guarantee approval, and approval can be withdrawn at any time — including for suspected fraud, repeated incorrect or mismatched banking information, or misuse of the delivery platform.
- Commission. 868POS retains a percentage of each delivery fee as a platform commission; the remainder is credited to the driver as earnings the moment a delivery is marked complete. The current commission rate is available on request and may be changed prospectively — a change never affects deliveries already completed.
- Banking accuracy is the driver's responsibility. A driver is responsible for keeping their banking details accurate and up to date. 868POS is not liable for a delayed, misdirected, or failed payout caused by incorrect, outdated, or fraudulent banking information supplied by the driver. Any change to banking details requires fresh verification before further payouts can be processed.
- Minimum payout and processing time. A payout can be requested once a driver's balance reaches the platform's minimum payout threshold. Once requested, a payout is processed within a set number of business days (a holding period, similar to standard practice on other on-demand platforms) before payment is made — this window allows time to confirm the request and complete the transfer, and is not a guarantee of same-day payment.
- Right to verify and withhold. 868POS may delay, withhold, or decline a payout, or request additional verification, where a driver's identity, banking details, or account activity appears inconsistent, suspicious, or unverified — including where a bank account holder's name does not clearly match the driver's verified identity.
- Not an employment relationship. A driver operates as an independent contractor, not an employee of 868POS or of any business on the platform. Drivers are responsible for their own tax obligations, vehicle, insurance, and compliance with applicable law.
7. Contact
Questions about these terms or how your data is handled can be directed to the business you're working with, or to the platform's own support channel.
